Chapter I General
Article 1 In order to strengthen the management of urban public lighting facilities, ensure the integrity of urban public lighting facilities, and promote urban economic and social development, these regulations are formulated in accordance with relevant laws and regulations and in conjunction with the actual conditions of this Municipality.
Article 2 These Provisions apply to the planning, construction, maintenance and management of urban public lighting facilities within the administrative area of â€‹â€‹this Municipality.
Article 3 The term "urban public lighting facilities" as used in these Regulations refers to street lamps and distributions used in urban roads (including streets, bridges, tunnels, squares, public parking lots), residential quarters, scenic spots, parks, green spaces, etc. Electrical facilities, poles, lamps, underground and underground pipelines, and other lighting accessories, facilities, etc.
Article 4 The municipal public security administrative department shall be responsible for the maintenance and management of urban road lighting facilities in this Municipality. The municipal maintenance facility comprehensive maintenance management agency is responsible for the daily management and supervision of the city's urban road lighting facilities.
The maintenance and management of public lighting facilities in Sun Yat-sen Mausoleum Scenic Area and Yuhuatai Scenic Area are under the responsibility of the management agency. The public security facilities maintenance management of other scenic spots and parks in this Municipality is the responsibility of the garden administrative department.
The administrative department of public lighting facilities in the county is responsible for the construction, maintenance and management of urban public lighting facilities within its jurisdiction.
The departments and units such as planning, construction, public security, real estate, land, power supply, telecommunications, etc. shall, within the scope of their respective duties, coordinate the management of urban public lighting facilities.
Article 5 Encourage and support the scientific and technological research of urban public lighting facilities, promote new technologies, new light sources, new equipment and computer automatic monitoring technology, and improve the scientific and technological level of urban public lighting facilities.
Article 6 Any unit or individual has the obligation to protect the city's public lighting facilities and has the right to stop, report and sue for violations of these regulations.
Chapter II Planning and Construction
Article 7 The planning and construction plan for the city's urban public lighting facilities shall be formulated by the municipal construction administrative department in conjunction with the planning department and, after being reported to the municipal people's government for approval, incorporated into the urban medium- and long-term plan and the annual construction plan.
The annual update and renovation plan for urban road lighting facilities shall be organized and organized by the municipal public administrative department.
Article 8 Urban public lighting facilities shall be planned in a unified manner, and shall be constructed and implemented in synchronization with urban roads, new district development, old city reconstruction and new residential quarters, and shall be coordinated with the surrounding environment. Residential districts that are not equipped with urban public lighting facilities shall be arranged by the relevant government departments and gradually matched.
Article 9 The construction plan and design drawings of urban public lighting facilities shall be implemented only after being examined by the municipal construction administrative department and the planning administrative department.
The units engaged in the design, construction, supervision and maintenance of urban public lighting facilities shall have corresponding qualifications.
The design and construction unit of urban public lighting facilities shall be determined through bidding and bidding.
The project quality supervision system is implemented in the construction and reconstruction of urban public lighting facilities.
Article 10 The construction of urban public lighting facilities shall focus on government investment and encourage social investment.
Article 11 The planning, design, construction and maintenance of urban public lighting facilities shall be carried out in accordance with the relevant national lighting design standards, low-voltage power distribution design specifications, lighting engineering construction and acceptance procedures.
Article 12 The power, telecommunications, street lighting, traffic signal signs and other facilities on both sides of the road shall be encouraged to be used together without affecting safety. The relevant units shall provide support.
Chapter III Maintenance and Management
Article 13 The competent department of urban public lighting facilities shall formulate and organize the implementation of the urban public green lighting project plan to promote the use of electrical equipment and products that comply with the green lighting technology.
Article 14 The maintenance and management of urban public lighting facilities shall follow the principle of safety first and ensure the integrity and normal use of urban public lighting facilities.
Article 15 Urban public lighting facilities shall be managed in accordance with the following energy-saving methods:
(1) Control methods such as time sharing and subsection;
(2) using reactive power compensation for gas discharge lamps;
(3) Regularly cleaning lighting fixtures;
(4) using energy-saving lighting equipment and energy-saving control systems;
(5) Using high-efficiency light source lamps and lanterns, and gradually eliminating lamps that do not meet the requirements of energy conservation and environmental protection such as low-efficiency light sources;
(6) Other energy conservation and environmental protection measures.
Article 16 The competent department of urban public lighting facilities shall perform the following duties:
(1) Establishing and improving the urban public green lighting energy-saving evaluation system and the urban public lighting energy-saving management monitoring system, and implementing urban public lighting consumption cost management;
(2) Arranging the operation and maintenance costs of urban road lighting facilities according to the annual plan of urban maintenance funds;
(3) urging the urban public lighting maintenance unit to perform its obligations as stipulated in the contract;
(4) supervising and inspecting the maintenance quality of urban public lighting facilities;
(5) accepting complaints about the maintenance of urban public lighting facilities;
(6) Other duties that should be performed according to law.
Article 17 The maintenance of urban public lighting facilities may be carried out in accordance with the provisions of laws and regulations.
Where a unit participates in a franchise bidding, it shall comply with the state's administrative regulations on the franchise of municipal public utilities.
Article 18 The urban public lighting maintenance unit shall perform the following duties:
(1) Formulating a maintenance plan;
(2) Maintaining in accordance with relevant technical specifications and contractual agreements to ensure the quality of maintenance;
(3) Accepting supervision and inspection by relevant departments;
(4) Other responsibilities as stipulated in the contract.
Article 19 If the urban public lighting facilities constructed by the government or the society are required to be handed over after passing the acceptance check, the construction unit shall report the transfer to the municipal construction administrative department, and handle the transfer formalities to the municipal public security department according to the regulations. Incorporate into normal maintenance management. If the project is not accepted or the acceptance is unqualified, the handover shall not be handled, and the original construction unit shall be responsible for the maintenance and management.
Article 20 If public lighting facilities need to be handed over or entrusted for maintenance, the following materials shall be submitted:
(1) A report on the quality of installation and construction;
(2) Technical information on maintenance and operation;
(3) Other materials that should be submitted according to law.
Article 21 The following acts are prohibited:
(1) damaging the city's public lighting facilities;
(2) dismantling, migrating, or altering urban public lighting facilities without authorization;
(3) arbitrarily stacking muck, garbage and building structures (structures) near the public lighting facilities in the city, blocking and covering the maintenance access and facilities;
(4) dumping corrosive waste liquid, waste residue and other wastes in the vicinity of urban public lighting facilities;
(5) arbitrarily receiving urban public lighting power supply;
(6) arbitrarily setting up communication cables or setting up other facilities on urban public lighting facilities;
(7) Setting and hanging objects on public lighting facilities in the city without authorization;
(8) Other acts of damage or encroachment on public lighting facilities in the city.
Article 22 If it is necessary to temporarily occupy urban road lighting facilities to set up or hang articles, the procedures for occupation shall be handled in accordance with the provisions of the â€œRegulations on the Administration of Urban Road Facilities in Nanjingâ€, and shall be set and hung at the specified location and time.
Article 23 If erection of communications, electric power facilities, etc., or access to urban public lighting power sources on urban public lighting facilities, it shall be approved in advance by the competent department of urban public lighting facilities and set up in accordance with the requirements of the safety technical specifications of lighting facilities.
Article 24 If it is necessary to dismantle, relocate or modify the urban public lighting facilities, or the construction may affect the operational safety, the municipal public lighting facilities competent department shall obtain the prior consent.
In case of emergency situations such as rescue and disaster relief, the city's public lighting facilities shall be demolished, relocated, and altered. The municipal public lighting facilities competent department and maintenance unit shall rush to the scene in time to take emergency measures for security.
Article 25 The safety distance of trees near urban public lighting facilities from charged objects shall not be less than one meter. For the lighting effect due to natural growth, it is necessary to prun the trees, and it should be reported to the municipal greening administrative department for approval. Due to force majeure, trees are seriously endangering the safe operation of urban public lighting facilities. They can be repaired first, and the relevant procedures will be re-submitted afterwards.
Chapter IV Penalties
Article 26 Anyone who violates these Provisions and commits one of the following acts shall be imposed a fine of not less than 200 yuan but not more than 1,000 yuan by the competent department of public lighting facilities of the city or county; if there is illegal income, it may be imposed at more than 1,000 yuan. A fine of not more than 10,000 yuan; if the facility is damaged, it shall be ordered to restore the original condition or compensate for the loss:
(1) dismantling, migrating, or transforming urban public lighting facilities without authorization;
(2) dumping corrosive waste liquid, waste residue and other wastes near the city's public lighting facilities;
(3) Damage to public lighting facilities in the city.
Article 27 Anyone who violates these regulations and accepts urban public lighting power without authorization shall be ordered by the competent department of public lighting facilities of the city or county to pay the electricity fee.
Article 28 Anyone who violates these Provisions, has been punished by laws and regulations, or is punished by other administrative departments according to law shall be prescribed by it.
Article 29 Anyone who steals or damages urban public lighting facilities shall be punished by the public security organ in accordance with the Law of the People's Republic of China on Public Security Administration Punishment; if a crime is constituted, criminal responsibility shall be investigated according to law.
Article 30 If the administrative personnel of urban public lighting facilities fail to perform or perform their duties or neglect their duties, abuse their powers, or engage in malpractices for personal gains in management and law enforcement activities, they shall be given administrative sanctions according to law; if they constitute a crime, they shall be investigated for criminal responsibility according to law.
Chapter V Supplementary Provisions
Article 31 The management of night lighting facilities in this city shall be carried out in accordance with the provisions of the â€œMeasures for the Administration of Night Lights in Nanjing Cityâ€.
Article 32 These Provisions shall come into force on February 1, 2007. The Regulations on the Administration of Urban Road Lighting Facilities of Nanjing Municipality promulgated by the Municipal People's Government on July 7, 1999 shall be abolished at the same time.
